Zayat Hit With $10 Million Libel Lawsuit By New York Attorney

Legal woes continued for Zayat Stables owner Ahmed Zayat on Monday when the owner American Pharoah was hit with a $10 million libel lawsuit in U.S. District Court five days ahead of his horse’s attempt to win racing’s Triple Crown.
The suit was brought by attorney J. Joseph Bainton of Bainton Lynch LLP in New York for what Bainton termed “blatant” and “malicious” lies Zayat took to the media once news of a breach of contract suit hit the national press in May.
The allegations stem from Bainton’s representation of Howard Rubinsky, who sued Zayat for breach of contract when Rubinsky said the latter failed to pay off $1.65 million in gambling debts. Bainton’s complaint notes that he and Rubinsky had no objection to Zayat’s concerns early in the proceedings that the nature of the breach of contract suit be kept under wraps, but that Bainton and Rubinsky had no control over the appearance of notes on the pending breach of contract case on a public website and that Zayat’s attorneys made no attempt to restrict public release of documents relating to the suit. When journalists stumbled across the notes following American Pharoah’s Triple Crown trail success, Zayat gave interviews regarding the case.
Zayat told a reporter for The New York Daily News on May 21 that the breach of contract action was “a fictitious story from people who are trying to extort me. It’s laughable. When we asked for any documentation, they have nothing. No documents, no proof, no receipts. Not a single word of truth. It’s insanity.”
Zayat’s choice of language in that and other stories about the case, Bainton argued, accused his opposition’s lawyer of committing crimes, rules violations, and ethics violations by implying that Bainton had knowingly been involved in fraudulent proceedings.
The suit also objects to Zayat’s insinuation that the breach of contract action only came up as a result of his Kentucky Derby and Preakness success with American Pharoah, when in fact Bainton said the case had been in court since March 2014.
“In short,” the suit concludes, “all of Defendant’s libelous declarations represent a childish temper tantrum caused by the fact that he and his lawyers simply forgot to attempt to keep from the public what are in fact public records.”
